Leading the way, however, was the Communications index, which gained 4.5%. The Banks-5 index chalked up a 1% gain for the day while the Real Estate-15 index rose by 0.4%. The Tel Bond added 0.6%.

In the communications sector, B Communications, which owns Bezeq, gained 8.5% on the day, while Bezeq itself rose by 6.1%. Internet Gold gained 8.25% and Cellcom and Parter, which does business in Israel as Orange, rose by 3.6% and 1.75% respectively, while HOT closed 7.5% higher. Who owns the copyright in the work we produce for a client?

As a designer if you are commissioned to create a work for your client, who owns the copyright in the underlying artwork?? This can become a fundamental issue for designers, and is often misunderstood by clients.? If problems arise it is usually because the issue hasn?t been clearly dealt with in your terms and conditions with your client.? It is imperative, at the very least, to have a written contract that covers the issue of the ownership of copyright.

What is copyright?

Here are some basic and fundamental features about copyright:

• Copyright is a type of intellectual property that covers certain original creative works
• Copyright is a bundle of exclusive economic rights such as the right to reproduce the material, perform the material, show or communicate the work to the public etc
• Copyright is automatic, it doesn?t have to be registered, published, or display a copyright notice on it.? Copyright exists as soon as the work is first put in material form.

The general rule about copyright ownership

The general rule in copyright is that the creator of the work is the first owner of the copyright.? But there are exceptions to this, and it can easily get a bit grey.? If you have not specifically dealt with the issue of copyright ownership in a document with your clients, a court may take the view that due to things done or said along the way, you have assigned the underlying rights to the client. Even if you didn?t mean to!

The problem

The problem is that clients often believe that because they are paying for the work that is being created that they ?own? the work and all of the underlying copyright that goes with it.? The result may well be that your client has far greater rights over your work than you intended.

You may for example be prevented from using the work in your portfolio.

You may even be prevented from using elements of the work in work for future clients.

Your client may decide to take your work and replicate it across other business ventures, or sell it online as a template!

The courts are full of examples of disputes that have occurred due to differing views on who owns the ?copyright? out of work conducted, and what rights the other party has to the use of that work. For example in the case of Concrete Pty Ltd v Parramatta Design & Developments Pty Ltd [2006] HCA 55 an architectural firm was contracted to design plans for a property development. A dispute ensued as to who owned the copyright and what each party was entitled to do with the plans. The High Court finally ruled on what rights each party held, but only after the case had already been through both a trial judge AND a Federal Court judge who both decided the case differently. It goes without saying that this would have been a very expensive and time consuming process for everyone involved, and unfortunately with an outcome that was almost impossible to predict for either parties at the beginning of the process.

So what?s the lesson to be learned from all this?

Agreement. Agreement. Agreement.

You need a written agreement, if you don?t want to leave the question of who owns what in the hands of a court that you can?t necessarily predict. ?Your agreement should cover these issues off in writing so if there is an argument, you have an answer in the document ? rather than leaving the outcome up to chance. The point of a clear agreement with your clients is to protect you and your rights, as well as inform your client so that problems don?t arise.

For example, you may have agreed to allow a client to use an image for a business card.? You should ensure that your client doesn?t get the right to use the work in ways you may not have intended, like selling it as a template to others. You might also want to be clear that any rights your client has to the use of the work doesn?t kick in until they have at least paid you!

A carefully drafted agreement should cover all of these sorts of possibilities, and a lot more.

The future of the euro is at stake: Spanish deputy PM

MADRID (Reuters) - Europe must move quickly with measures to pull Spain back from the brink of a debt crisis, with the future of the euro common currency at stake, Spanish Deputy Prime Minister Soraya Saenz de Santamaria said.

Saenz, a long-time politician in the centre-right People's Party, spoke with Reuters Editor-at-Large Harold Evans during a critical week for Spain as it seeks to fund a 19-billion-euro rescue of one of its biggest banks and the country's autonomous regions face a liquidity crunch.

Spain's borrowing cost hovered close to an unsustainable level on Tuesday - the yield on the benchmark 10-year government bond was 6.5 percent - as investors worry costly rescues of the regions and banks will push Spain's finances over the edge.

Spain has made enormous strides in containing its deficit and making its economy more competitive, Saenz said, but it needs European-wide measures to give confidence to the common currency and restore calm to markets.

"If the EU doesn't reinforce the euro zone with some sort of mechanism, it's not about who leaves (the euro), it's about the EU itself. What is the EU without the euro?" Saenz, 40, said at the prime minister's complex, Moncloa, on the outskirts of Madrid on Monday.

"It's about the future of the euro."

Spain is asking for huge sacrifices from its citizens she said, with budget savings this year of more than 45 billion euros, which have meant spending cuts in schools and hospitals.

At the same time, she noted, interest payments on debt this year will rise to 30 billion euros.

"For states that are making the effort it's not possible to explain to their citizens that what they save through austerity will then be spent on higher interest payments on debt," said Saenz, a lawyer by profession and one of Prime Minister Mariano Rajoy's closest advisors.

Meanwhile, almost one in four Spanish workers is jobless and unemployment is expected to rise even further in the coming months as the economy contracts again after barely emerging from its last recession.

"Countries which are doing reforms need to find a way to be rewarded rather than punished," she said, pointing to her government's overhaul of labor market rules to make companies more competitive, as well as its reforms of the financial sector.

SWIFT EUROPEAN ACTION NEEDED

Spain says it can foot the rising bill to rescue its banks on its own, after a property market crash left them with more than 184 billion euros in sour assets.

And the government is expected to announce later this week guarantees that will help the country's 17 autonomous regions refinance their debt.

Saenz declined to say what measures European institutions should take, saying "the European Central Bank is an independent institution."

"We would like the decision to be taken as quickly as possible, with agility. That's better for everyone, not just for Spain. We have to clear up doubts," Saenz said.

On the European stage Spain has pushed for immediate solutions such as more ECB liquidity or purchases of Spanish sovereign debt on secondary markets by the central bank.

For the short-term Spain does not foresee any euro area agreement on joint debt, or eurobonds.

Saenz said voters who go to the polls in Greece and France on June 17 must know that Europe as a whole will back countries that are tightening their belts to meet Europe-agreed deficit cutting targets.

"I trust that (the European institutions) are very aware, especially at this moment, that they have to send a clear message to countries that have elections," she said.

"The message from the EU should be that serious governments are treated with the same seriousness that they are acting with. This is a good message for citizens who need to take political decisions," she said.

GOOD NEWS ON SPAIN

Saenz said that while markets are focused on Spain's risks there is also a lot of good news that should be taken into account.

The PP has an absolute majority in Parliament, which means it can act swiftly to pass reforms.

Under Rajoy's government's repeated threat of sanctions, the regions submitted very austere budgets for this year.

Spain badly missed its deficit target last year, it came in at 8.9 percent of gross domestic product rather than 6.0 percent, mainly because of overspending at the regional level.

Although the collapse of the construction sector left the economy with a gaping hole, Saenz said there are bright areas and that Spain's indices of competitiveness are improving.

"We have a very internationalized economy, exports have been growing in recent years and new market niches have been opened," said Saenz.

She said that other European countries should fall in line with Spain's conviction that austerity and growth are not mutually exclusive.

"You need fiscal consolidation in order to grow," she said.

Justin Bieber's new single "Die in Your Arms" is full of funky beats, Motown harmonies and good old-fashioned romantic longing. In the song, produced by Rodney "Darkchild" Jerkins, Bieber just wants to make the apple of his eye believe he loves her so much that he'd rather die in her arms than be away from her for too long.

The song's vintage swing, finger snaps and melodies certainly recall the heyday of feel-good R&B from the 1960s, which is mirrored in the song's sentiment. On the chorus, Bieber sings, "Honestly, the truth is, if I could just die in your arms/ I wouldn't mind/ 'Cause every time you touch me/ I just die in your arms/ It feels so right/ So baby, baby, baby, please don't stop girl."

In keeping with the song's vintage feel, at one point, he breaks from singing to say, "Oh, baby, I know loving you ain't easy, but it sure is worth a try."

"Die" is the follow-up to the more pop-'n'-b-leaning "Boyfriend," which he dropped back in March. Last week he dropped a remix to the song, featuring 2 Chainz, Mac Miller and Asher Roth, which certainly ups the song's hip-hop ante quite a bit. "And we can be like Selena and Biebs/ Wild and free, a couple disobedient teens/ Sneaking out to meet like two o' clock in the eve/ Paparazzi ain't a problem, we just hide on the beach," Roth spits on the track.

Bieber is currently abroad promoting his June 19 album release, Believe, amid allegations he got into a scuffle with a paparazzo over the weekend while out in Los Angeles with girlfriend Selena Gomez.

"i hope when you guys hear #BELIEVE you finally understand how i feel about you. I appreciate and love you. this is about us. thank you," he tweeted over the weekend about the album release, shortly after news broke of the fray with the photographer.

Ohio legislature OKs bill on energy fracking rules

COLUMBUS, Ohio (Reuters) - The Republican-led Ohio legislature approved a bill setting rules for drilling and related activities in the state's shale gas industry, in a vote late on Thursday, responding to a series of small earthquakes in Ohio last year that experts linked to a practice called fracking.

Republican State Representative Peter Stautberg said the new measure will ensure safe development of Ohio's shale gas reserves while allowing the energy industry to prosper.

"There is a balance that is to be struck between the industry and the administration ... without hampering the industry to such an extent that it destroys the efforts of this state to take advantage of the natural resources," he said.

The bill, which now goes to Republican Governor John Kasich for his signature, requires increased disclosure of chemicals and water used in the fracking process.

Fracking is the controversial practice of injecting chemical-laced water and sand into shale to release oil and natural gas.

Critics say that the high-pressure injection of the liquid into rock causes seismic activity. Some states have either banned fracking or placed strict restrictions on how it is carried out.

The bill also requires water sampling within 1,500 feet of proposed water wells. It mandates that oil and gas wells be tracked between the time they are drilled and the time they are capped. It requires that waste fluids from other states be disclosed before they can be injected into wells in Ohio.

And the legislation requires increased inspection of wells, and forces well owners to hold liability insurance coverage.

Many Democrats said the bill paves the way for the industry to hide information about toxic chemicals that could contaminate groundwater.

"You have grandchildren. You have kids that could be exposed to these dangers," Democratic Representative Bob Hagan said.

But the measure passed the House by a vote of 73 to 19 and the Senate concurred by a vote of 21 to 8.

Kasich said he will sign the legislation.

"I'm so excited about what this legislation accomplishes and what it means for Ohio's future," he said.

A series of 11 small earthquakes culminating in a New Year's Eve tremor with a magnitude of 4.0 in the Youngstown, Ohio, area prompted the state to place a drilling moratorium on five wells.

The Ohio Department of Natural Resources said in March that the high-pressure injection of fluid underground related to fracking caused the earthquakes.

Ohio has nearly 200 deep wells in 41 counties, with 177 of those wells used primarily for oil and gas waste disposal. Since 1983, more than 202 million barrels of oilfield fluids have been disposed of in Ohio, more than half from out of state.

NASA Ames helps re-enter the Dragon

ScienceDaily (May 23, 2012) ? Decades of rigorous research, testing and development performed in the Entry Systems and Technology Division at NASA's Ames Research Center, Moffett Field, Calif., has garnered Ames' thermal protection engineers the respect of not just other government agencies, but also commercial entities.

"For four decades, whenever the U.S. government or aerospace industry needed thermal protection capabilities for space flight missions, Ames delivered the technology developments that enabled those missions to go forward," said Chuck Smith, chief of the Entry Systems and Technology Division at Ames. "Our work plays a key role in both government and industry space flight endeavors."

The successful re-entry in late May or early June of the cutting-edge Dragon spacecraft from its demonstration flight to the International Space Station will be enabled in part by thermal protection system (TPS) technologies developed, tested and flight-qualified at Ames. Developed by Space Exploration Technologies Corp.'s (SpaceX), Hawthorne, Calif., the capsule will launch atop a Falcon 9 rocket also built by SpaceX, from Space Launch Complex 40 at Cape Canaveral Air Force Station in Florida.

Unlike any other cargo carrier, the Dragon is designed to bring things back to Earth, a boon for scientists whose research is taking place on the orbiting laboratory. In order to safely return the Dragon to Earth, SpaceX chose to incorporate the Ames-developed Phenolic Impregnated Carbon Ablator (PICA) thermal protection material into their heat shield design for the Dragon capsule. PICA is a heat shield material slightly more dense than balsa wood that is designed to protect spacecraft during their fiery re-entry into Earth's atmosphere. For example, NASA applied PICA on the Stardust sample return capsule, which brought back to Earth the first comet particles and interstellar dust samples in January 2006. Stardust holds the record for the fastest Earth re-entry speed of any human-made object.

To apply this innovative heat shield technology, SpaceX engineers worked with Dan Rasky -- an original developer of the material, senior scientist and director of the Emerging Commercial Space Office at Ames -- along with other thermal protection materials researchers and scientists at Ames.

"When people get serious about entry systems design, they come to Ames for the capabilities, experience and unique facilities needed to do that work," said Rasky. "They understand the future of heat shields is taking place in the here-and-now."

This forged a public-private partnership NASA envisioned as a key component to achieve the agency's mission to closely collaborate with Commercial Orbital Transportation Services (COTS) partners. A team at Ames performed the initial design analysis for the Dragon thermal protection system using Ames-developed tools, including the Arc Jet Complex that is used to simulate the in-flight hot gas flow environments the spacecraft experiences during re-entry.

The PICA-based version of the heat shield material developed by SpaceX, is called PICA-X. PICA-X protects the spacecraft's structure during the intense heating environment experienced during re-entry. These samples were tested in the arc jets at Ames in order to understand the material's response to re-entry conditions. Engineers at Ames conducted two series of thermal protection system material testing for PICA-X in December 2008 and June 2011. During the tests, the surface temperature on the PICA-X samples reached approximately 3,450 degrees Fahrenheit -- almost twice as hot as lava.

The PICA-X system is passive, meaning it's not load bearing, and it protects the vehicle by absorbing heat and re-radiating it out into space, helping the spacecraft maintain its shape and structural integrity. On the other hand, active systems keep heat away from the vehicle's structure by partially burning or charring it, which changes the vehicle's shape in the process.

"We have an outstanding team who were thrilled to have the opportunity to work with industry, because it helps us expand our portfolio of capabilities, while gaining new insights into emerging technology challenges," said Mary Livingston, chief of the Systems Analysis Branch in the Flight Vehicle Research and Technology Division at Ames. "Eventually we transferred some of those capabilities to SpaceX so they could perform subsequent design iterations."

Enabling the Future

The Dragon is expected to become operational and launch regular supply runs to the space station. To further take advantage of private-public partnership opportunities like the one between NASA and SpaceX, Rasky believes it is vital for NASA to return to the model established by the National Advisory Committee for Aeronautics (NACA), created by Congress in 1915 to support the fledgling aviation industry.
